These terms apply to the apps “Ocean Insight”, “Forest Animals Insight”, “Desert Animals Insight”, “Birds Insight”, “Insects Insight”, “Safari Insight”, “Dogs Insight”, “Horses Insight” (together “the apps”). By downloading or using an app you agree to them.
1. Provider
The apps are developed and offered by Tom Göckeritz, Kaulsdorfer Str. 8a, 12621 Berlin, Germany ([email protected]).
2. What the apps are
The apps are learning apps about animals. Each day they show an animal card with a profile, picture and quiz, plus a collection, a map, streaks, levels, badges and prehistoric animals. They are available for iOS and Android. Each app is separate, and purchases apply only in the app where they were made.
3. Free version and Premium
The apps are free and show ads from Google AdMob. You can also unlock new animals by choosing to watch ad videos, within the limits shown in the app.
Premium is a one-time purchase, not a subscription. It removes ads and unlocks the benefits listed in the app at the time of purchase, currently unlimited streak freezes, extra colour themes and free unlocks within a weekly allowance.
You can also buy single animals. Such a purchase permanently adds that animal to your collection.
4. In-app purchases
In-app purchases are handled only by Apple (App Store) or Google (Google Play). The store is the seller and your contract partner for payment, and its terms apply. Prices shown are final prices including applicable sales tax. Purchases are tied to your store account and can be reactivated under Settings → Restore purchases, including on a new device for Premium. Single animals are consumable purchases and are stored only on the device where you bought them.
4.1 Right of withdrawal for consumers in the EU
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise it, you must inform us (Tom Göckeritz, Kaulsdorfer Str. 8a, 12621 Berlin, Germany, [email protected]) of your decision by a clear statement, for example by email. It is enough to send your notice before the withdrawal period ends.
Effects of withdrawal. If you withdraw from this contract, we will refund all payments received from you without undue delay and no later than fourteen days from the day we receive your notice.
Early expiry (§ 356(5) German Civil Code). For digital content not supplied on a physical medium, the right of withdrawal expires once we have started performance after you (a) expressly agreed that we start before the withdrawal period ends and (b) acknowledged that you thereby lose your right of withdrawal. The app asks for this consent in the purchase dialog before the content is unlocked.
You can also request refunds for store purchases directly from Apple or Google, as they act as the seller.
5. Content and AI images
The texts are based on publicly available sources, mainly Wikipedia, and every card lists its sources. We check the content carefully but cannot guarantee that it is complete, current or free of errors, and scientific classifications change. The apps are for entertainment and general education and are no substitute for expert advice, for example on keeping, health or breeding of animals.
The animal pictures are generated with artificial intelligence and labelled “AI-generated image” in the app. They are not photographs and may differ from the real animal in details. The extra photos in Ocean Insight come from Wikimedia Commons and are under the free licences stated there.
6. Age
The apps are suitable for all ages. We recommend that younger children use them with an adult. Parents should manage purchases with Apple's or Google's parental controls.
7. Licence
You receive a simple, non-transferable right to use the apps on your devices for private, non-commercial purposes. You may not copy, distribute, modify or reverse engineer the apps or their content except where the law expressly allows it.
8. Rights in the content
The design, texts, pictures and app names belong to Tom Göckeritz or are used with the rights holders' permission. Map data comes from Natural Earth and is in the public domain. The fonts are licensed under the SIL Open Font License. Licences of software libraries are listed in the app under Settings → Open source licenses.
9. Liability
We are liable without limitation for intent, gross negligence, injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.
10. Changes
We may change these terms for good reason, such as new features or changes in the law. We will announce material changes in good time in the app or on this page. Content you have already bought is not affected.
11. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer in the EU, you keep the protection of the mandatory laws of your country of residence.
